ChristGiftUs respects the intellectual property of others and expects the people who use christgiftus.com to do the same. This page explains how to tell us about material on the Site that you believe infringes your copyright, and how to respond if your material has been removed by mistake. It works alongside our Terms of Service, in particular the sections on intellectual property and on content you provide.
1. Our position on intellectual property
We sell gifts, many of which are produced after an order is placed and some of which carry personalization supplied by the customer. We do not knowingly sell products that infringe someone else’s copyright, and we do not knowingly print customer-supplied images or text that infringe. Where a customer submits content for personalization, our Terms of Service require them to confirm that they own it or have permission to use it, and we may refuse or cancel any order that appears to infringe.
2. Designated agent
Notices of claimed copyright infringement, and counter-notifications, should be sent to our designated agent:
DMCA Agent, ChristGiftUs
378 S Teller St, Lakewood, CO 80226, United States
Email: [email protected]
Subject line: DMCA Notice
Email is the fastest route and is the method we prefer. Please do not send takedown notices through the general contact form, as that delays handling.
3. How to file a takedown notice
To be effective under section 512(c)(3) of the Digital Millennium Copyright Act, your written notice must include all of the following:
- A physical or electronic signature of the copyright owner, or of a person authorised to act on their behalf.
- Identification of the copyrighted work you say has been infringed. If several works on the Site are covered by a single notice, a representative list of those works.
- Identification of the material you say is infringing, with enough detail for us to locate it. Please give the full URL of each product or page; a description alone is often not enough for us to act.
- Your contact details: full name, mailing address, telephone number and email address.
- A statement that you have a good faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or are authorised to act on the owner’s behalf.
A notice that is missing any of these elements may not be legally effective, and we may come back to you for the missing part before acting.
4. What happens after we receive a notice
We review every notice we receive and act promptly on those that are complete. Where a notice is valid we will remove or disable access to the material, which for a product listing normally means unpublishing the product so it can no longer be viewed or ordered. If an order for that product is already in production, we will stop it where we still can and refund the customer.
We will make a reasonable effort to notify the person who supplied the material, and to pass on a copy of your notice so that they can file a counter-notification if they believe the removal was a mistake.
5. Counter-notification
If your material was removed and you believe it was removed by mistake, or that it was misidentified, you may send a counter-notification to the agent listed in section 2. Under section 512(g)(3) it must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before removal.
- A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Your full name, mailing address and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if your address is outside the United States, for any judicial district in which we may be found, and that you will accept service of process from the person who filed the original notice or their agent.
6. What happens after a counter-notification
We will forward your counter-notification to the person who filed the original notice. Under the DMCA, if that person does not tell us within 10 to 14 business days that they have filed a court action seeking to restrain the activity, we may restore the removed material. This waiting period is set by the statute and we cannot shorten it.
7. Repeat infringer policy
In appropriate circumstances we will restrict or terminate the account of anyone who is the subject of repeated notices of infringement, and we may refuse to accept further orders or submissions from them. We keep a record of the notices we receive so that repeat cases can be identified.
8. Trademark and other complaints
The DMCA covers copyright only. If your complaint concerns a trademark, a right of publicity, a person’s name or likeness, or another right, the counter-notification procedure above does not apply. Send those complaints to the same email address with the subject line Trademark Complaint, and include the registration details of the mark where you have them, the goods and services it covers, and the URL of each listing you are complaining about. We handle these on their own merits.
9. False or abusive claims
Section 512(f) of the DMCA provides that a person who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and legal fees. Please be sure of your rights before you send a notice or a counter-notification. If you are not certain, consider taking legal advice first.
10. Changes to this policy
We may update this policy from time to time. Changes take effect when posted on this page, and the date at the top shows when it was last changed.
